**SIDE NOTE: Having never done this type of video live, I addressed some commenters and yet the live comments aren’t still here. Not sure if they show up later or just never show up. My bad. I’m ignorant with YouTube live if it’s not obvious in the video lol.**

Well, I’m trying to make lemonade here people. The audio from our podcast episode 2-3 recordings were unusable but I had so many requests for a response to the Nurse getting arrested in Utah video and the cop making a “racist” comment in Georgia video that I didn’t want to let you guys down.

That means…I went live and addressed the issues. I also want this video to stand as an example of why I’m completely capable of being objective and calling it like I see it, even when the cops are in the wrong.

  2. The unconscious man was a victim in this accident after a high speed chase, which was against police policy. The cop was just trying to cover his ass about this chase. He is a bully and should not be a cop. I've grown up with cops, some are like my brothers. If one of them acted in this way, I would not support them, and I'd be disgusted. I hope she sues his ass off, he deserves it.

  3. The patient they were trying to get blood from was the victim and was unconscious. Mike I heard you say you think the cop was wrong which I think half these idiots commented before you said that. Love your videos keep up the great job and stay safe out there.   4. The Utah incident was all ego. Video contradicts all lies. No narrative is without bias. Video doesn't lie. It may not tell the who story, but it also prevents officer narratives that are fiction.

  5. The Utah case was worse than he implies. The patient was very seriously injured as the direct result of an illegal high-speed police chase. The patient was 100% an innocent victim who was hit by the vehicle they were chasing. The officers involved, and the department were in serious trouble – their careers were on the line and they were likely going to be sued for millions. So they were on an illegal fishing expedition to steal the patient's blood in the hope that they would find evidence of drugs and smear him in an attempt to save their skins. When the nurse very properly refused to be bullied the cop lost his temper and arrested her violently. This was totally illegal and she was awarded $500k in punitive compensation.

  6. Your demeanor and shirt says it all. I've dealt with this for 7 years that makes me an expert on the law. No it makes you an arrogant fool. You still come across as an a _ _ hole. You misspoke on many levels. Your first was the accident. It was a police chase the suspect crossed lanes and ran into the truck. Maybe the Utah officer was trying to cover up the chase. Again berating someone is pure hatred and arrogant. With your mentality a cop is probably all your qualified for. Stay safe and carry daily

  7. Police must have a probable wrong or crime to demand anything from AMERICANS. This case had no such thing. This unfortunate person was driving and hit by a crazy person driving the wrong direction chased by police. The police is not allowed to do so in this situation. Why do the police want a blood sample from this poor guy?? I want you to explain all this per "context" as you say.

Unfortunately there are the few ppl out there whether they majored in English or did not graduate that will always think they know more or have had the worst end of the stick and therefore say idiotic things.   9. The important that Mike missed is implied consent only governs "if lawfully asked to do so by a peace officer." Since the man was unconscious in the burn unit (and later died), he could not give consent and the officer could not ask him directly. The nurse had no requirement to do the blood draw without a warrant, period.

  10. It is true that there is a systematic problem with police accountability. Maybe not nurse abuse, but there are too many cops, and they all have qualified immunity.

    If you think that "implied consent" means a warrantless blood draw can be performed on the victim of an accident while that person needs emergency care, I suggest you speak carefully to a civil rights lawyer who can explain how wrong you are. Doubly so if you think police can conscript nurses to perform medical battery against their will and that it is a crime if they refuse that justifies an arrest by force while the patient's emergency is ongoing, as at that point you are at risk of potentially being credibly accused of criminal conduct if you act on that belief. The maximum crime officers in a case like this could conceivably be accused of is depraved heart murder if a patient whose life was clearly in danger dies because officers took malicious action against their care provider whose efforts were necessary to save the patient's life.

  12. Without commenting on the specifics of this case, in this situation, the cop is the one who should shut up and follow the nurse's orders, not the other way around.

    * Both are emergency response personnel.
    * Both have authority to make critical decisions in emergency situations.
    * Both are professionals with professional responsibilities.

    However:
    1. A nurse has more training than a cop.
    2. A nurse has a professional license.
    3. A nurse is more qualified than a cop to assess whether someone's life is in danger.
    4. A nurse has a professional and legal duty to take care of a patient. A cop does not, legally speaking, have a legal duty to protect the public.
    5. A cop has qualified immunity, but a nurse has obligations that are not abrogated by an unlawful order if the order is so plainly bad and unlawful that obeying it is unreasonable.
    6. Depending on the level of unreasonableness apparent from a reasonable person in the nurse's position, a nurse could conceivably go to prison for criminally negligent homicide for obeying an officer's unlawful order to not care for a patient if death results, or else have to rely on a defense like entrapment which essentially involves admitting wrongful action and admitting non-criminal responsibility for unlawful action.

  13. I don’t know if most cops are good or most cops are bad because I don’t know most cops but I actually respect your point of view as a cop. You’re totally right about the cop in Georgia. It very well could be that he made a horrible joke but he could be a good cop. You can’t judge someone by one mistake or even a few mistakes they might have made.

  14. He lives in the trash can and he does drugs and drinks beer then he got arrested for harassment sex abuse and two counts of assault and he got fired and that crazy cop was fired and he died and that the reason I hate cops that arrest people for no reason

All law enforcement agencies have a double standard they silence Minister and pastor by threatening them with jail time or arresting them law enforcement agencies are all about silent in the word of God and yet law enforcement protects the perverse and the Abominations the perverse and the Abominations get to have their little meetings anybody who is a minister or pastor for somebody that just tries to have Bible study meetings gets arrested for trying to share the word of God how can you call yourself a police officer when your law enforcement agencies are doing this to people of God I love you guys and I pray for you and I pray you wake up before Destruction comes upon this Earth

  16. You are blowing smoke. They made the agreement so live with it. This case was not in Michigan so lets bring up more Michigan law. There is no excuse for this low life cop or his superior, none. You are trying to make these low life people look better than they are. You are not telling why the truck driver was in the accident. Police didn't follow their own rules.

  18. Warrants are issued on probable cause. Nothing I've seen indicates the driver did anything wrong. He was just in the wrong place at the wrong time, when the cop's were engaged in a high speed chase. Unless the officers were going to lie about the actions of the driver, any reasonable judge would deny a request for a warrant.

  19. nurses and cops are ON THE SAME TEAM…. as the son of a life long medical professional i feel like this whole thing was a BIG WHOOPSIES…. i live in SC but i did take a Utah CWP class here in SC (i got both cause there are like 18 states that recognize SC but like 36 that recognize SC and Utah combined… plus the more CWP's and training u have the better and more qualified to carry and defend yourself u look in front of a judge and jury… i know that sounds silly to any non-carriers but IT MATTERS) and Utah has alot of what u might call "common sense" laws… like they just make sense compared to the jumbled up gobaldy guk u might get reading the law books in MOST west/east coast states…things like "no person may sue a party found to be acting in self/property defense… (that's a big one here cause u can almost GUARANTEE u will be sued by the family of the person u shoot in a self defense situation in SC … if he don't rob it, they gon' take it… that's a local saying) just read some of the self/property defense laws for Utah and u will see what i mean… i swear i'm MOVING to Utah first chance i get…. just for their laws…

  20. @Mikethecop If the aresst is wrong then everything that took place is wrong. Also if arrest is wrong than jis putting hands on her was wrong. And must have been cause the cop was fired from 2 jobs.

  24. Uhh sorry bud, but my fiance and I were behind a vehicle and it was struck by a truck killing one of the passengers. The cop never tested the driver of the truck. When confronted as to why he didn't he said it was 8:30 am and no one drinks in th he morning…… so wrong us wrong, get off that high horse and remain silent when your wrong.

  25. Thank you Officer Mike. I'm a retired helicopter flight nurse and my ex had me wrongly arrested. Am I angry at the arresting officer? Absolutely not. He was doing his job as he understood the circumstances in a respectful, polite manner. I've of course been exonerated in a court of law. It wasn't the fault of the deputy that my ex lied, trying to have me thrown out of my home as opposed to awaiting the divorce. As a previous County Hospital ER RN and flight nurse, I've had the privilege of encountering multiple law enforcement officers. I expressed my gratitude for their honor and devotion by instituting a Critical Incident Stress Debriefing program in a rural area. I apologize for the lengthy comment but I hope the public will recognize that 99.9% of officers protect our lives. Thank you Mike.

  26. I go back and watch this every 6 months or so. Yeah, that officer likes to beat up women. And assuming he put her under arrest, where were the frickin' Miranda rights? BAD COP! Period. Bad Cop period. This would have been thrown out as a good arrest, even if it were not a woman beating cop, upon first review. Nurse – totally sane. Cop – bad cop. I hope he never has a job in his life again above cleaning toilets. Cop BAD (idiot) in this case. I support the police in general, but this is the kind of stuff that makes cops look bad.

  27. I understand this video is 3 years old but Mike you are very condescending in your tone and the way you speak to people (Sandra). I am a cop and if I seen you speaking to a civilian the way you speak to people on YouTube I’d definitely put you in your place. EVERY single time I’ve heard you speak on a situation involving a cop that did something wrong you make a poor attempt at condemning what they did and in the same breath you’ll poorly attempt to defend what they did. Whenever there’s a civilian that commits a criminal activity you’ll do whatever you can to condemn the actions of that person.

  28. In this case, the only "implied consent" is for medical treatment. And as soon as the hospital, and by extension Nurse Wubbles, has taken the person into their charge, they have a legal obligation to protect his privacy. That would include requiring a warrant or arrest to remove that consent from the person. She acted as a patient advocate, she enforced laws put in place for this circumstance specifically. Nurse Wubbles had a moral, professional and legal responsibility to act as she did. And she was very harshly arrested and treated to interrogation. I don't know if she was taken down town and booked into SLC jail, which is a shithole BTW. But she stands up for her patient. As a nurse I swore an oath, and part of that oath is to always be a patient advocate, and to always protect the dignity, privacy and safety of my patients. If I was being led into UofU ED and saw her, I would know I have a nurse I can trust to know her stuff and speak on my behalf.
