Bakersfield, CA — On March 10, 2024, Kern County Sheriff’s Office deputies responded to a domestic violence report in the 200 block of East Beardsley Avenue, Bakersfield.

The caller, the suspect’s wife, reported domestic abuse and mentioned that her husband was armed with both a gun and an axe before she sought refuge across the street.

Deputies arrived at the scene around 1:13 p.m. Dispatchers managed to contact the victim by 1:20 p.m.

Upon arrival, deputies found the suspect in the front yard of his residence, holding a rifle and an axe. Despite repeated announcements over the public address system for over 20 minutes, urging the suspect to drop his weapons, he did not comply. The Mobile Evaluation Team was dispatched but did not arrive before the officer-involved shooting took place. Additionally, a call was made for the SWAT team, including the crisis negotiation team, but the shooting occurred during their response.

Deputies provided medical aid until further medical personnel arrived on scene.

The footage available is from a body camera that provided the clearest view of the scene, not from the deputy involved in the shooting. Deputy Nicholas Rocha, positioned tactically in a nearby residence, was the one who fired the shot, but his body camera’s view was obstructed.

The suspect, Cole Jackson Hughes, aged 53, received medical attention at the scene and was then transported to the hospital for treatment of his injuries. He was arrested for charges including domestic battery, felony resisting, and brandishing a firearm. Unfortunately, Hughes succumbed to his injuries and was pronounced deceased the following day, March 11th.

Hughes’ wife, Lynn Hughes said about the rifle,
“It was an empty pellet gun,”

According to California Department of Justice DIVISION OF LAW ENFORCEMENT:
Deadly Weapon
Per AB 1506, OIS Investigation Procedural Guidelines: A “deadly weapon” includes, but is not limited
to, any loaded weapon from which a shot, readily capable of producing death or other serious
physical injury, may be discharged, or a switchblade knife, pilum, ballistic knife, metal knuckle knife,
dagger, billy, blackjack, plastic knuckles, or metal knuckles. (Gov. Code, § 12525.3, subd. (a)(1).)
All firearms, and BB/pellet guns, even if unloaded or inoperable, are deadly weapons.
Objects that have a legitimate non-weapon purpose are considered deadly weapons only when,
based on all the circumstances, they are used in a manner likely to produce death or great bodily
injury. The following are examples of objects that have been considered a deadly weapon when
used in that manner: knives, box cutters, screwdrivers, bottles, chains, automobiles, rocks, razor
blades, baseball bats, and iron bars.
Replica firearms (including Airsoft guns) are not considered deadly weapons unless they are used in
some particular manner likely to produce death or great bodily injury (e.g., as a bludgeon).
