Trooper Shoots Bean Bag Rounds at Man Standing On a Roof With a Hand Saw

Newfane, Vermont — On June 17, 2022, around 2:15 a.m. a homeowner called Vermont State Police to report that a guest in his home was acting irrationally and causing damage to the residence. When Vermont State Police Sgt. Ryan Wood, 36, and Tpr. Zachary Trocki, 29, responded, they found 61-year-old Marshall Dean on the roof of the house. The troopers try to communicate with Dean for about two minutes, concerned about what they believe is a saw in Dean’s hand.

Less than two minutes after responding to the scene, Trooper Trocki shot Marshall Todd Dean with a Super-Sock bean bag projectile fired from a Remington 12 gauge shotgun from a distance of approximately 77.8 feet. Soon after being struck, Dean falls about 15 feet to the ground. He was transported by ambulance to Brattleboro Memorial Hospital and subsequently transferred to Dartmouth Hitchcock Medical Center in Lebanon, New Hampshire, for treatment of significant injuries. Attorney General Cleak concluded the use of force was not justified because Dean posed no immediate danger to anyone.

On May 2022, the Vermont Attorney General’s Office filed charges against the troopers for both reckless endangerment and simple assault, but Windham County Superior Court Judge Katherine Hayes dismissed those charges, saying there wasn’t evidence that the bean bag caused the man to fall off the roof. Both troopers pleaded not guilty to the misdemeanor charges. Prosecutors with the Attorney General’s Office indicated they were considering refiling the assault charges, and that they wanted to submit video evidence to support their case. The case against Wood and Trocki is the first time Attorney General Clark has filed criminal charges against law enforcement officers.

  4. I see nothing wrong. He didn't comply after at least a dozen requests and he absorbed the shot well over 5 sec before falling. He didn't die. Move on.

  5. Ffs! The officers used less than lethal to subdue him not harm him, yet the DA tries to prosecute them. This world is being run by snakes and cowards!

  6. He wasn't a danger to anyone? He was disturbing the peace. And he obviously was a danger to himself. As shown by his slipping and falling off the roof.

  7. I'm not sure which I'd rather never face in the cops arsenal, bean bags or pepper spray. On one hand the pepper spray probably feels rough for longer, but I think a bean bag would be more painful, just in a shorter time. Plus, whatever it hits is just not gonna work for a while. A K-9 though COULD be kinda fun…So long as you're in one of those full body suits. If not, then a K-9 is an easy vote for the worst to have happen.

  8. Here you have a first time AG who is looking for a Political Agenda for himself. His case…he was a danger to no one but he forgot to say, he was to himself…allegedly high on drugs and is in position of a saw. Add him to the list of Cops hater.

  9. The nerve of the DA to even bring up charges to officers, he should be fired for bringing up frivolous charges.. Would shooting him with real ammunition have been a better outcome?
