  1. It was going well, until the cop got cocky and started being a tyrant. Escalation instead of de-escalation. I feel for this guy. This should have NEVER happened. That cop needs to be fired. PERIOD

  2. Mr. Stark gets an F-. If the cops are at the house for a domestic issue, it's going to be he-said, she said by definition. And, it's the cops who will decide whom to believe, at least at that moment. That's time time to show the cops you're not angry or aggressive and that you're in control of your emotions.Β 

    An ID check isn't the hill to die on, especially as his girlfriend will ID him, maybe even providing the cops with a utility bill or other document. Arguing with the cops over it, on the other hand, made the cops' decision for them. They'll never just leave if the man is angry and argumentative.

    Are officers paid extra for every ID they collect?

  4. Again, it doesn’t matter, even if they did, or didn’t have a ironclad written lease. The cops are not in the don’t have the power to enforce that until a judge orders someone to leave in all 50 states, the only person that can evict you from somewhere or you have some legitimate right to be residentially, I mean is a judge the judge grants the order and if needed the sheriff or some long first one authority, execute it if the person doesn’t leave his order, but the cops can’t arbitrarily decide you have a right to be here you don’t it’s not up to them to civil matter for a judge to decide.

None of the laws regarding tenancy, have anything to do with it those are civil matters, not criminal matters one person officers don’t have the authority or power to enforce civil issues who goes and who stays is not up to the cops if she has any demonstrable right to be there i.e. keys or anything that shows she’s been staying there then she has a right to stay in. The cops can’t change that same with him that’s up to a judge federal law, regulates tenancy to be fair state laws have very little power over tenancy because the fair housing act regulates tenancy in, and its supremacy is pretty much unchallengeable

  8. i had a co-tenant who was renting a room in a large home having several tenants. the owner and all of the tenants wanted her out but she wouldn't move. finally, we removed all of the furniture from her (furnished) room. that convinced her to leave.

  9. Texas is shit for uphold men's rights in this situation. I had a friend who hooked up with a stripper. It been over 30 years. They had known each other for 3 week and she was sleeping at his place for 2 weeks. She pulled a kitchen knife on him. He grabbed her arms disarmed her and pushed her away to secure the knife. She calls the police. He get arrested but the police will not remove her from the apartment. They say that he was common law Marriage. Which is not possible because that take 6 months of co-habitation. He get charge for domestic abuse and spends money and time going to court and her never showing up. It final got dropped after 2 and a half year. I she has showed and Amber Turd it. She would of been facing time and a record. He was an Air Plane mechanic and it would of hurt his chances of getting employed

  10. Now I understand why my father-in-law never let his girlfriend of 14 years stay overnight more than one night a week at his home and he wouldn’t allow her to keep any property there. Laws like these.

  15. When a police officer violates the law, citizens should be allowed to sue the officers directly. It's not fair for the tax payers to pay for the mistakes of stupid or tyrannical cops.

  16. Every officer who commits a false arrest should lose his job and receive a minimum of 6 months prison sentence. This is basically kidnapping . Ignorance of the law is not a defense. Cops should be held accountable. If the citizen knew that he didn't have to provide ID , there was no excuse for the police officer not to know.

  17. NEVER voluntarily give up ANY rights. That would include letting cops into your home without a warrant that spells out EXACTLY what they are there for. Of course, they can always violate your rights by breaking in. But, that can be financially addressed in the civil courts.

  18. "You're in custody" sounds much more like "under arrest" than "detained".

    Doesn't "custody" put on higher standards, such as protecting and ensuring the welfare, safety, and health of the subject?

  20. I had something similar to this happen number of years ago except I was the one that called the cops and I still got taken away and when I came back to my apartment whatever she didn’t take she destroyed

  21. This happened to me, a senior. Police told me to leave my house to give my son a break for a couple of hours. My 35 year old son was verbally assaulting me. I tried to come back later that day and the abuse escalated with throwing my personal items down the stairs. I left again and went to the county court house next morning with no appointment. A judge squeezed me in, believed my story and I got a restraining order before 12:00. My son refused to leave so he was arrested. It took 8 sheriffs. By the way, when I first called the non emergency police number, the cops at my house told me I should have called the sheriff.
