  3. You could simply pull the body cam footage of the history of officers and find out how they handle themselves individually to situations. All situations and then you will get a better idea of how it works.

  4. The odor of marihuana is sufficient to search a vehicle, but not a person. What a wonderful system. It is absolutely impossible for anyone to know what is and isn't allowed.

  5. It is truly paradoxical the difference in the concept of freedom that exists in the United States and that which exists in Italy and other European countries

    the Italian supreme court establishes regard to the crime of resistance to public official in criminal code:

    -The crime of resistance exists only if there is evidence of violence or threats or actions that endanger the safety of agents or other people
    -The mere fact fail to obey an any officer's orders never constitutes a crime
    For example, it is not a crime to refuse to get out of the car, I s not a crime to refuse to stay away or to go back in the house.

    -that any passive and peaceful resistance is not a crime.
    In cases where there is no evidence of a voluntary attack on property to directly influence the activity carried out by public officials, so as to carry out direct oppositional conduct, the violent nature of the action must be excluded, which essentially results in a lack of collaboration, which in itself is not sufficient to integrate the constituent elements of the crime of resistance
    For example, it is not a crime to lie down in front of your car to prevent it from being seized.

    -in the absence of elements that make clear the danger to public safety and the indirect psychological coercion of public officials, the crime of resistance will not be considered.
    For example ,it is not a crime not to stop at a police checkpoint or to flee on foot if this does not create risks and dangers for people.
    The person who, while driving a car and not having stopped at the "red" signal, had attempted to escape the pursuit of the officers by traveling at high speed, does not have to answer for this crime.

    On the other hand, the constitution clearly says that coercive obligations are permitted only by a written and reasoned act of the judicial authority in the ways established by law.
    Only the refusal to comply with the dictates contained in a judge's order can constitute a crime, for example not approaching a person's house, or not frequenting the houses of convicted criminals during parole.
    No other person in Italy can order anything from anyone.

    Italian law say, Regard to the use of handcuffs, is permitted only if the person is objectively a danger to the safety of others or himself.
    When transferring a prisoner to other places, handcuffs are used only with the authorization of the public prosecutor if the prisoner is awaiting trial.
    or with the authorization of the supervising judge if the prisoner is a definitively convicted person.

    We clearly see the difference between a system where the authority to limit freedom and give orders or use the force is granted to officials of the executive power dependent on the government who have political and various interests.
    and a system where this authority, in addition to being much more limited, is exclusively granted to the judiciary, not dependent to the government and which has no interest beyond law enforcement.

  6. I’m so sick & tired of these cops saying “I think I smell Cannabis, can you get out?” Such a cop out for an illegal search & seizure. This is just one more reason why it needs to be legalized on a Federal Level. Since Oregon passed Cannabis, cops have lost ways to do illegal search & seizures. It’s made our State that much safer.

  7. B+ my ass, what a clown cop he has no control of his ego and emotions and should never be a cop with such a sensitive attitude. Dude was shaking like crazy handing him the citation, obviously not built for this job, he is literally a ticking time bomb.
