He should’ve stopped the traffic going by, she was facing the road. He just didn’t want you there filming him violating that woman. However she was drunk like a skunk.
Based on this logic any bird or cloud passing by could also be in the peripheral vision, could distract form the investigation, and therefore should be arrested.
DONT DRINK AND DRIVE but if you ever find yourself in this situation REFUSE all field sobriety tests and the breathalyzer!! the less evidence they have the greater the odds are of the DUI getting dismissed. I've talked to several Leo's about this and they have all said the same thing, refuse all tests and say nothing. it's hard to get a conviction without the tests.
don't be afraid when they tell you " by refusing you will automatically loss your license for 1 yr".. this is true, BUT if the case is dismissed your license will automatically be reinstated! most likely they will try to get a warrant for a blood sample to use as evidence..but in many states that can be difficult and sometimes isn't granted. without tests all they have is the officers account that you were
" driving erratically", which could of happened for a number of reasons, the reasonable doubt is there..
To me it looks like they knew she was dui so they just wanted to make sure she couldn’t use your presence as an excuse for failing the test in court.

Prick cops did the same thing to me last week and had to let me go after I registered 0.000 on the breathalyzer, even though I stumbled doing the gymnastics test.

SHAME ON HER for being so irresponsible and driving while CLEARLY drunk! I could tell as soon as she was doing the finger trace test that she was drunk as a skunk because she was swaying back and forth. I can't stand someone who drives drunk. I've seen what that can do to a family when that drunk takes someones life! When I was working as security at a hospital, they brought in the bodies of a young man and woman who had been killed by being hit head on by a drunk driver and I had to be there when those people's family arrived to the hospital to get the bad news. I'll never forget the wailing and screaming. The couples 2 year old daughter was with her aka the female victims parents. Then going into the er to see the man that had hit them with scratches on his face but nothing else wrong with him. It made me so angry! SHAME ON YOU WOMAN!

WHY do police not use RBT devices as a first test can anyone tell me this please. I'd just say F it take me in im too pissed to do these tests that cop has been more than accommodating but even someone that wasn't drunk would be forced to go through the same exercise over and over again until they falter it should be if you pass each tests the first time round no matter what a cop thinks there should be no reason for him to have you keep performing the same exercise over and over. I'll bet if you got a cop to do these tests over and over they would fail at some point like stand on one foot with the other foot raised tilt his back close his eyes count back from 100 and do this 3 or 4 times he would fail at some point too
Just love to see cops perform the FS test they keep doing it for as long as it takes for you to show one moment their not happy with that way they believe their conscience is clear and the arrest justified.
Ok, please tell me how this poor lady is seriously supposed to flawlessly complete these field sobriety tests after having just been through an impact MVA? Seriously, if she has a concussion, she'd fail every one of their tests. I know, I've had 4 on the wrestling mat and sometimes you act drunk; dialated eyes, confusion, loss of motor skills.. If she has a good law representative, like Larry the DUI guy (for instance), I bet she gets charges dropped, as long as she refuses ALL breathe tests, including the one at the jail.

Unless they offered this to EVERY person pulled over then I could understand. But as you said, yes they do these tests on the side of the road with cars coming etc.
